TomoCabs – Terms and Conditions

Welcome to TomoCabs, a platform operated by Tomo Services. that connects riders with independent drivers for personal and commercial transport services.
By registering, downloading, or using the TomoCabs mobile or website, you agree to comply with and be bound by the following terms. Please read them carefully.
1. Acceptance of Terms
By using our services, you confirm:

That you have read and understood these Terms.

That you agree to comply with them in full.

If you are using our service on behalf of someone else or a company, you confirm that you are authorized to accept these Terms on their behalf.
2. Eligibility
You must:

Be 18 years or older.

Not be prohibited from using mobile or online services by any applicable law or regulation.

Have an active mobile number and internet access.

Use a valid payment method when booking paid rides.
We reserve the right to suspend or terminate accounts if we find users to be underage or providing false information.
3. Description of Services
TomoCabs is a ride-hailing platform that:

Connects riders (passengers) with drivers for on-demand transportation.

Allows users to schedule, track, and pay for rides using the app.
-
Offers different ride types (economy, premium, outstation, rentals) depending on availability and city.
Important: TomoCabs does not own or operate any vehicles. All drivers on the platform are independent contractors, not employees of TomoCabs.
4. User Registration and Accounts
To use TomoCabs:

You must register with a valid phone number and verify your account via OTP.

You may be required to set up a user profile with your name, email, and optional payment methods.
You agree to:

Maintain the security of your login credentials.

Not share your account with others.
-
Accept responsibility for any activity done via your account.

Immediately report any unauthorized access to your account.
5. Booking Rides
a. Ride Request

Input your pickup and destination address.
-
View estimated fare (this may vary slightly due to real-time conditions).
b. Driver Matching
-
The app assigns the nearest available driver.
-
You will see driver details (name, vehicle, rating) before the ride begins.
c. Ride Completion
-
The driver will mark the trip as completed at drop-off.

You’ll receive a ride summary and payment confirmation via SMS/email/app.
6. Fare and Payment
a. Fare Calculation
Fares may depend on:

Base fare, distance traveled, time taken, surge pricing, and traffic.

Additional charges for tolls, parking, waiting time, and peak hours.
b. Payment Methods

Cash

UPI
-
Credit/debit cards
-
In-app wallet (if applicable)
c. Invoice
A digital invoice will be issued after the ride for your records.
7. Cancellation & Refund Policy
a. Cancellation by Rider

Free cancellation if done within [X] minutes of booking.

A cancellation fee will apply if the driver has already arrived or is en route.
b. Cancellation by Driver

If the driver cancels for any reason, no charge will apply to the rider.
c. Refunds

Refunds are initiated for failed payments, overcharges, or system errors.

Processing time: 5–7 working days.

Refunds go back to the original payment method.
8. Driver Conduct & Responsibility
We expect every driver to:

Maintain a clean and roadworthy vehicle.

Follow traffic laws and safe driving practices.
-
Be courteous, punctual, and professional.
-
Never engage in discriminatory or inappropriate behavior.
TomoCabs may suspend or ban drivers based on repeated poor ratings or complaints.
9. Rider Responsibilities
As a user, you agree to:

Provide accurate pickup and drop-off details.
-
Be respectful to drivers.
-
Not damage or dirty the vehicle.
-
Not engage in unlawful, offensive, or dangerous behavior.
Violations may lead to:

Account warnings

Temporary or permanent suspension
-
Legal action (if serious)
10. Location Access
The app requires access to your GPS/location for:

Matching you with nearby drivers.

Accurate route planning.
-
Real-time tracking during the ride.
Your location is only accessed and used when the app is in use or during a trip.
11. Ratings and Feedback

After each trip, riders and drivers can rate each other on a 1–5 star scale.

Feedback helps us improve service quality and identify misconduct.

Abusive or fake reviews are not allowed and may result in account suspension.
12. Promotions and Offers
TomoCabs may offer:

Promo codes

Referral bonuses
-
Wallet cashbacks
These are:

Non-transferable
-
Subject to change or cancellation
-
Valid only for limited periods or specific users
13. Service Limitations
TomoCabs does not guarantee:

Continuous availability of the platform.

Availability of drivers at all times.
-
Perfect route or fare accuracy.
The app may experience outages, delays, or interruptions due to maintenance, upgrades, or network issues.
14. Limitation of Liability
TomoCabs is not liable for:

Accidents or incidents during the ride.

Theft, loss, or damage to your belongings.
-
Delays or service unavailability due to third-party failures.
Our liability is limited to the amount paid by the user for the specific ride in dispute.
15. Intellectual Property
All app designs, logos, code, and content are owned by or licensed to TomoCabs. Users cannot:

Reproduce, copy, or reuse any part of the platform.

Reverse engineer the app or scrape its data.
16. Privacy Policy

17. Account Termination
We reserve the right to:

Terminate or suspend your account at any time without notice for violations.

18. Governing Law and Jurisdiction
These Terms shall be governed by the laws of India. Any disputes will be resolved exclusively in the courts of Odisha.
